Your Rights if Bags are Lost

Category: Airline & Luggage By Countries

You have been waiting for quite a long time for your luggage and everyone else from your flight seems to have already found their luggage and has left.
What should you do if your bags do not arrive at your destination on schedule when the conveyor belt stops?

With so many people flying, it is unavoidable that airlines may lose your luggage sometimes. It will be very frustrating to arrive at the destination without your luggage. So you should know how to handle this awkward situation if this does happen to you.

Please report your loss to the airlines baggage agents before you leave the airport. It is vital to do this as soon as possible so they may obtain information on locating your luggage.

This usually means you have to file a detailed report to baggage service counter. Their staff or handling agent will give you instant help. Dragonair will send you a missing property questionnaire for more information if you do not receive your luggage within 72 hours after your report.

Limits of liability
The extent of airline liability is neither based on the weight of the bag nor its value. Airlines in Hong Kong do not accept liability for damage to fragile items, spoilage of perishables, loss of keys, artwork, cameras, money, jewelery, precious metals, silverware, medicines, drug, dangerous goods, commercial goods, odd-sized articles, negotiable papers, securities, or other valuables, business documents, passports and other identification documents, or samples (both checked and unchecked luggage).

On international flights, compensation limits are set by the Warsaw Convention. It is limited to a maximum of $9.07 per pound (US$20.00 per kilo) for checked baggage and US$400.00 per passenger for unchecked baggage. Where the Montreal Convention applies, the liability is limited to approximately US$1,375 per passenger for both checked and unchecked baggage.
