How to Enforce Airline's Liability for Damage

This article discusses remedies and methods of enforcing airline liability for damage of your luggage in Hong Kong. If your suitcase and belongings arrive damaged, the airline will negotiate a settlement to pay you its depreciated value based on certain limitations.

Their staff or handling agent is available for arranging repairing services and providing assistance to you.

In Hong Kong, airline's liability for damaged luggages follows applicable conventions. Liability for any damage to baggage is limited unless a higher value is declared in advance and additional charges are paid.

According to Warsaw Convention, for many international journeys, including domestic portions of international journeys, the liability is limited to approximately US$9.07 per pound (US$20.00 per kilo) for checked baggage and US$400.00 per passenger for unchecked baggage.

In some cases, as per Montreal Convention, the applicable liability limit is 1,000 special drawing rights (about US$1,375) per passenger for checked and unchecked baggage.

Airlines may decline to pay for damage caused by the fragile nature of the broken item or perishable items, keys, artwork, cameras, money, jewelery, precious metals, silverware, medicines, drug, dangerous goods, commercial goods, odd-sized articles, negotiable papers, securities, or other valuables, business documents, passports and other identification documents, or samples, which are included in your checked baggage.
