Exercise Your Rights When Your Luggage is Damaged

Category: Airline & Luggage By Countries

Claim for Damaged Luggage
No claim for damage may be made in the case of damage to luggage, unless the passenger entitled to delivery complains to an office of Japan airline companies immediately after the discovery and no later than 7 Days from the date of receipt.
And in the event that the check-in baggage is damaged, the passenger should notify the airport staff when he/she claims his baggage. Many Japanese airline companies are not liable for damage to check-in baggage, unless the damage is obviously caused by the carrier.

Compensation for Damaged Luggage
Unfortunately, damage of luggage might happen under some circumstances. Japan airline companies work with luggage repair at major airports. They provide door-to-door delivery of repaired or replacement luggage and are responsible for appropriate repair or replacement costs.

If the luggage is beyond repaire, the age of possessions may be taken into account. Japan airline companies will compensate your loss based on market value and depreciation of the damaged luggage. Please be reminded that the primary function of luggage is to protect its contents. Some damage may be in connection with the nature of the baggage or its contents. Japan airline companies must refuse certain kinds of damage, in accordance with international rules, as described below:
1. Minor damage of protruding parts such as wheels, feet, straps, locks, extending handles, hanger hooks, loose flaps, pockets or any kind of attached item.
2. Minor dent or scratch or torn on baggage
3. Internal damage and damage caused by contents.
4. Damage to over sized/over-packed bags.
5. Cardboard boxes and other packing containers not suitable for carriage.
6. Baggage with Limited Release tags.
7. Baggage with inadequate packing.

Limitation of Liability
Most Japanese airlines companies are not liable in the event of damages such as loss or breakage of these items. They are as follows:

1. Expensive items: Cash, jewelry, precious metals, securities, bills of exchange, works of art and antiques.

2. Valuable items: Documents, electronic data, passports and other personal identification required for travel, samples, credit/bank cards, cash vouchers, bankbooks, checks, commuter passes, keys, computers and computer accessories, mobile phones, film cameras, digital cameras, video cameras, medication, paintings, watches, mementos, etc.

3. Fragile articles: Musical instruments, sports equipment (including surfboards, windsurfing equipment, scuba gear and bicycles), ceramics, glass articles and liquors, although adequate precautions will be taken in their handling.
